Understanding Virginia Divorce
In Virginia, the general rule is that a person cannot file for divorce if he or she is still living with the spouse. It is physical separation, living in two different residences, typically, that allows the divorce laws to operate. In limited circumstances, however, it is possible to comply with the principle of living separate and apart, while in the same residence. The period of separation for a no-fault divorce is at least one year. That period is reduced to six months if the couple has signed a separation agreement and there are no children involved.
There must be legal grounds (reasons) for a couple to divorce. The primary reasons recognized by Virginia law are:
- Adultery
- Desertion: leaving your spouse with the intent to permanently end the marriage
- Cruelty: physical cruelty toward a spouse or child
- One year separation
- 6 months separation with a separation agreement and no children
