Types of Spousal Support in Virginia
Our state offers two types of spousal support:
Temporary support: This type of support is paid during the separation period. The amount is based on need versus ability to pay. Litigation can occur if there are questions about the income and expenses of either spouse. There is currently an effort underway to create guidelines for temporary support awards. Those guidelines already apply in the Juvenile and Domestic Relations District Courts.
Permanent support: This type of support is ordered as part of the final divorce decree. The judge can order support to be paid for a certain number of years. Support also ends when the recipient remarries. The amount is based on a number of factors, including the parties’:

- Length of marriage
